05: Weighing up the case
Taking legal action should only be considered as a last resort, and it may be more cost-effective to write off small debts instead.Much depends on whether your claim is likely to be disputed. If – as is the case with many business debts – it is not disputed, you can obtain a judgement without the help of a solicitor, and will not normally have to attend a court hearing.
If, on the other hand, you think your customer might dispute the claim and you are unsure of the outcome, you may need to consult a solicitor or local advice agency.
Furthermore, even if you expect to win the case, remember that the court cannot help if your customer has no assets.
