03: Constructive dismissal

A constructive dismissal occurs when it is the employee rather than the employer that terminates the employment contract, but where the employer’s conduct gave the employee no alternative but to resign. It is fundamental to a constructive dismissal claim that the employer has actually breached the employment contract or that the resignation occurs in anticipation of the employer’s breach of contract.
